Garda O’Mahony to Stand Trial on Multiple Charges

A member of the Garda Síochána, Alan O’Mahony, stationed at Letterkenny Garda Station in County Donegal, is set to stand trial on five charges including burglary, harassment, criminal damage, assault, and sending grossly offensive messages. The case is proceeding to the Letterkenny Circuit Court following a recent mention at Letterkenny District Court.

Details of the Allegations

The charges stem from an incident that occurred on June 30, 2024, at a property in Wood park, Lismonaghan, Letterkenny. O’Mahony is accused of entering the building as a trespasser with the intent to commit an arrestable offense, violating the Criminal Justice (Theft and Fraud) Offences Act, 2001 [[1]].

Further allegations include the criminal damage of a duvet by burning it with a lit cigarette, demonstrating either intent to damage or reckless disregard for potential damage, as defined by the Criminal Damage Act, 1991 [[2]]. He is also charged with assaulting Joseph O’Donnell, contravening the Non-Fatal Offences Against the Person Act, 1997 [[3]], and causing damage to a front door at the same location and time.

Additionally, O’Mahony faces a charge under the Harassment, Harmful Communications and Related Offences act, 2020 [[4]], relating to the alleged sending of a grossly offensive photograph of a woman to another individual with the intent to cause harm.

Court Proceedings and legal Portrayal

The case was initially heard before Judge Ciaran Liddy at Letterkenny District Court. State solicitor for Donegal, Kieran Dillon, confirmed that the Director of Public Prosecutions has consented to the case proceeding to the circuit court on all charges.

O’Mahony, who resides at Commons Road in Cork, was not present in court and is currently on sick leave. His solicitor, Patsy Gallagher, requested legal aid for his client, which was granted, citing that O’Mahony is currently unable to work due to the ongoing legal proceedings. Gallagher also requested the assignment of legal counsel, given the seriousness of the allegations, a request which was also approved by Judge Liddy.

The court has been furnished with statements by the prosecution, and a signed plea is being considered. The case has been adjourned until March 3rd to allow for this consideration.
