US Army Corps of Engineers Withdraws Port of Iberia EIS

The U.S. Army Corps of Engineers is withdrawing its Notice of Intent to prepare an Environmental Impact Statement for the Port of Iberia navigation feasibility study in Louisiana, opting instead for an Environmental Assessment. Study conditions have changed since the publication of the Notice of Intent, prompting the federal agency to scale back its formal documentation.

Shifting Environmental Review Standards for Louisiana Navigation

Federal officials determined that forecasted impacts from the proposed navigation project will not cause significant adverse effects on the human and natural environment. While unavoidable impacts to wetlands remain part of the project scope, the agency confirmed that these disruptions will be fully mitigated. Because full mitigation is achievable, an Environmental Impact Statement is no longer warranted.

James A. Bodron, Programs Director, Mississippi Valley Division, is associated with the procedural shift. Any future federal actions tied to the navigation study will comply with the National Environmental Policy Act of 1969, as amended, alongside the Department of War NEPA Implementing Procedures issued on September 3, 2026, and other relevant environmental review standards.

Decades of Feasibility Studies and Legislative Authorizations

The regulatory pivot marks the latest chapter in a planning process. Congress originally authorized a study to determine the feasibility of carrying out a project for navigation at the Port of Iberia under Section 431 of the Water Resources Development Act of 2000 (Pub. L. 106-541).

A final Feasibility Report and EIS were completed in 2006. However, a Record of Decision for the EIS was not signed. Later on, Congress greenlit the undertaking through Section 1001(25) of the Water Resources Development Act of 2007, with modifications introduced by Section 6004(a)(7) of the Water Resources Reform and Development Act of 2014.

The initial Federal Register publication of the Notice of Intent on October 31, 2002 (67 FR 66388), ceases to be in effect as of November 2, 2026.

Upcoming Public Review and Environmental Documentation

The U.S. Army Corps of Engineers, New Orleans, located at 7400 Leake Ave., will issue a public notice in advance of the availability of EA #611 and a draft Finding of No Significant Impact. Once finalized, a copy of the signed FONSI will be hosted for public viewing and download on the U.S. Army Corps of Engineers project website.
