Howth Restaurant Settles Defamation Claims with Traveller Community Members

Five members of the Traveller community have settled defamation claims against Howth Railway Refreshment Rooms and its security company, Security Partners, following an incident in 2022 where they were allegedly refused entry despite having reservations. The settlement amount was not disclosed in court, but the claimants had initially sought damages up to €75,000 each.

Background of the Case

In April 2022, Pat and Margaret Gavin, John and Kathleen McDonagh, and Mary Reilly made reservations at the Howth Railway Refreshment Rooms. Upon arrival, they allege they were told their reservations had been cancelled and were “not getting in tonight.” The five complainants claimed they were left feeling humiliated and portrayed as disreputable and dangerous in front of other patrons.

Previous Discrimination Claims

Prior to the defamation claims, the five individuals were awarded damages in the District Court for discrimination by the restaurant. The Howth Railway Refreshment Rooms issued written apologies in February 2023 regarding the incident, but without admitting liability. The restaurant had previously paid each of the five €900 as compensation for the discrimination claim, considering it adequate compensation for any alleged defamation.

Allegations of Malice

The claimants argued that any qualified privilege the restaurant might claim was undermined by malice, specifically due to their membership in the Traveller community. They contended that the alleged statements constituted prohibited conduct under the Equal Status Acts.

Restaurant’s Defense

Howth Railway Refreshment Rooms maintained that any concerning statements were made solely by a doorman at the entrance and only in the presence of the other members of their reservation party.

Settlement and Court Outcome

On Tuesday, February 18, 2026, barrister Dermot Francis Sheehan, representing the claimants with O’Hanrahan Solicitors, informed Judge Ken Connolly in the Circuit Civil Court that the defamation claims had been settled. The judge struck out the claims with no order as to legal costs.
