A landmark settlement of €1.5 million has been reached in a High Court case involving a 12-year-old boy with cerebral palsy. The boy, James Prior, was born in 2012 at Mullingar Regional Hospital and subsequently transferred to a Dublin hospital due to his deteriorating health. His family alleges that the care provided after his birth contributed to his condition, leading to legal action against the HSE.

The Case for Negligence Alleged in Court

James Prior’s lawyers argued in court that a cranial ultrasound conducted a day after his birth showed no abnormalities, but five days later, the ultrasound revealed issues with his brain cells. They asserted that all of James’ difficulties arose after his delivery, suggesting an “injurious insult” to his brain following his birth. They further claimed that emergency measures should have been taken and that the two-hour ambulance journey to Dublin worsened James’ condition.

HSE Denies Claims, Settlement Reached Through Mediation

The HSE vehemently denied all the claims brought against them. However, the parties eventually reached an interim settlement of €1.5 million after mediation. This sum represents a 25% reduction for litigation risk. The settlement will cover James’ needs for the next five-and-a-half years, after which the court will assess his future care and loss of earnings.
