Examples of this are common, with manny stemming from companies not taking the process seriously and making errors or accusations due to a lack of due diligence. A more concerning issue is when the DMCA takedown process is used fraudulently to exact revenge against an enemy. The fact that this is even possible highlights the problem with taking content down first and asking questions later.

Recently, a video game titled No Players Online was released on Steam. It’s a horror game and a sequel to a 2019 freeware game of the same name. Many of the original team,including Adam Pype,created the sequel under the developer name Beeswax games. Shortly after its release, the game was taken down from steam due to a DMCA claim.

The claim wasn’t from a copyright holder, but from someone claiming the game infringed on a tabletop RPG they created called Chronoscape. The claimant, a Jason Vinson, alleged that No Players Online copied elements from Chronoscape, despite the two works having virtually nothing in common. Vinson had previously engaged in a public and opposed dispute with Adam Pype over a different matter, making the DMCA takedown appear retaliatory.
