ICC Upholds Detention of Former Philippines President Duterte
The Appeals Chamber of the International Criminal Court (ICC) on Friday, March 6, 2026, rejected an appeal by former Philippines President Rodrigo Duterte against the decision to continue his detention. The ruling, issued on January 26, 2026, stems from an investigation into alleged crimes against humanity committed during his “war on drugs” campaign.
Background of the Case
Duterte is suspected of crimes against humanity, specifically murder and attempted murder, allegedly committed as part of a widespread and systematic attack against a civilian population in the Philippines between November 1, 2011, and March 16, 2019 (ICC, 2026). An arrest warrant was initially issued under seal on March 7, 2025, and made public on March 11, 2025 (Borden, 2025). Duterte surrendered to the ICC on March 12, 2025, and his initial appearance took place on March 14, 2025. The confirmation of charges hearing was held from February 23-27, 2026.
The Appeal and ICC Ruling
The defense argued that the Pre-Trial Chamber erred in disregarding a health report submitted on their behalf, claiming it originated from a party to the proceedings. However, the Appeals Chamber dismissed this argument, noting that the report contained no new information regarding Duterte’s health condition, as the medical practitioners who prepared it had not conducted a new examination (ICC, 2026). The Chamber emphasized that assessing the impact of Duterte’s health on risk factors is a legal determination, not a medical one.
Jurisdictional Considerations
Despite the Philippines’ withdrawal from the Rome Statute in March 2019, the ICC maintains jurisdiction over crimes committed while the Philippines was a State Party. The Court’s investigation was authorized in 2021, and the ICC has asserted that its jurisdiction is not subject to any time limit for crimes within its purview (Borden, 2025).
