Federal Judge Blocks RFK Jr.’s Overhaul of Childhood Vaccine Schedule

A federal judge in Massachusetts on Monday blocked Health Secretary Robert F. Kennedy Jr.’s recent overhaul of the nation’s childhood vaccine schedule, marking a significant setback for his vaccine agenda. The ruling stems from a lawsuit brought by the American Academy of Pediatrics (AAP) and other medical groups against the Department of Health and Human Services (HHS), alleging that Kennedy’s changes to vaccine recommendations and to an influential vaccine advisory committee violated federal law.

Changes to the Vaccine Schedule

In January, Kennedy and the Centers for Disease Control and Prevention (CDC) made changes to the childhood vaccine schedule, reducing the number of recommended diseases to be vaccinated against from 18 to 11 . This change dropped recommendations for universal vaccination against hepatitis A, hepatitis B, RSV, dengue, and two types of bacterial meningitis.

Medical Community Response

In response to the changes, over 200 groups, including the American Medical Association, the March of Dimes, and the Autism Science Foundation, announced they would disregard the revised recommendations and continue to follow the AAP’s immunization schedule .

Impact of the Ruling

The judge’s decision also halts the implementation of new members Kennedy appointed to the CDC’s Advisory Committee on Immunization Practices (ACIP) since June. The ACIP plays a crucial role in shaping U.S. Vaccine policy, including recommendations that influence the childhood vaccine schedule and insurance coverage. According to Richard Hughes, the AAP’s attorney, the ruling effectively prevents the committee from holding its scheduled meeting this week .

An HHS official confirmed the postponement of the meeting. The ruling also suspends any votes taken by Kennedy’s ACIP since June, including a vote to discontinue recommending the hepatitis B vaccine for all newborns.

Setback for Kennedy’s Policies

The decision represents a setback for Kennedy, a longtime critic of vaccines, who had promised to restore trust in public health agencies. However, his controversial policies have generated confusion among pediatricians and contributed to increased distrust in childhood vaccination, according to experts. A recent survey by the Annenberg Public Policy Center of the University of Pennsylvania indicated a decline in trust in public health agencies during President Trump’s second term.

“Today is a day to celebrate the triumph of science over misinformation,” said Dr. Richard Besser, president of the Robert Wood Johnson Foundation. “This is a huge blow to Kennedy’s vaccine policies.”

Dr. Andrew Racine, the AAP’s president, stated that the ruling “re-established a degree of clarity” regarding childhood vaccinations. “If anyone has any questions about what’s the appropriate vaccine schedule for their children, the best thing to do is to talk to their pediatricians.”

HHS Response and Potential Appeal

An HHS official stated that the agency intends to appeal the decision. Hughes suggested the case could potentially reach the Supreme Court. Andrew Nixon, an HHS spokesperson, said the agency “looks forward to this judge’s decision being overturned just like his other attempts to keep the Trump administration from governing.”

Kennedy’s Broader Vaccine Policy Changes

Since taking office, Kennedy has implemented a series of measures to reshape federal vaccine policy. These include firing all 17 members of the ACIP in June and replacing them with his own appointees, many of whom have expressed skepticism towards vaccines. He also introduced new rules for vaccine testing, which experts believe could hinder the approval of new shots. Kennedy has taken steps to restrict access to COVID-19 vaccines for individuals under 65 and removed a recommendation for healthy children and pregnant women to receive the shots. He has also adopted a more cautious stance on vaccines utilizing mRNA technology.
