Legal Battle Over Trump-Appointed U.S.Attorney Heats Up in L.A.

A federal judge heard arguments Tuesday regarding the Trump governance’s methods for installing Bill Essayli as acting United States attorney in Los Angeles. The question? Are those methods improper, and if so, what happens next?

During the hearing downtown, senior Judge J. Michael Seabright-who traveled from Hawaii for the case-considered a tricky situation. Defense attorneys want indictments against three clients dismissed and Essayli disqualified from all criminal prosecutions in the district.

Essayli, a former Riverside County assemblyman, was appointed interim top federal prosecutor by U.S. Atty. Gen. Pam Bondi in April. His initial term was set to expire in late July. Confirmation by the Senate or a panel of judges was needed for continuation.

But the White House didn’t nominate him for a permanent role.Instead, they used a unique legal maneuver. This shifted his title to “acting,” extending his term another nine months without any confirmation process.

Seabright, chosen from the District of Hawaii after local judges recused themselves, questioned the fallout of dismissing charges. “If I did this for yoru client, I’ll have to do it for every single defendant indicted while Mr. Essayli was acting U.S. attorney, correct?” he asked a deputy federal public defender.

“I don’t think you will,” James A. Flynn replied. “This is a specific, case-by-case analysis. The court doesn’t need to decide a dismissal is appropriate in every case.”

“Why not? You’re asking for a drastic remedy here,” Seabright countered, then asked how many indictments had been issued as Essayli became acting U.S. attorney at the end of July.

“203, your honour,” Assistant U.S. atty. Alexander P. Robbins responded.

In a court filing before the hearing, prosecutors argued that dismissing indictments would be “unusual” and “unwarranted.” They maintained Essayli’s appointment was lawful.
