Irish Rail and Homeowners Dispute Embankment Collapse Near Dart Line
The owners of a property in Malahide, Co Dublin, are disputing claims made by Irish Rail (Iarnród Éireann) and Córas Iompair Éireann (CIÉ) that an outbuilding on their land caused a recent embankment collapse that briefly disrupted Dart services.
Legal Action and Claims
Iarnród Éireann and CIÉ have sought a High Court injunction against Kieran Brady and Virginia Synnott, alleging that the outbuilding was constructed “to a highly significant extent” on land owned by CIÉ, located behind their property at Ashleigh Lawn, Malahide. Irish Times and BreakingNews.ie reported on the legal proceedings.
The transport companies contend that water runoff from the outbuilding contributed to the embankment’s failure on or around January 29th, leading to a temporary closure of the Dart line. Irish Times
Homeowners’ Response
Brady and Synnott, who were reportedly out of the jurisdiction in the southern hemisphere when the initial proceedings were served, dispute the claims. Their solicitor informed Irish Rail that the land belongs to them and alleges some negligence on the part of the transport companies. BreakingNews.ie
They have refused to provide undertakings to remove the outbuilding or reinstate the boundary line with the rail lands. Irish Times
Current Status of the Case
As of March 3, 2026, the case is ongoing. Judge Brian Cregan has indicated the matter is urgent, given the potential for further inclement weather and its impact on Dart line operation and public safety. Irish Times
Raymond Delahunt, representing Irish Rail and CIÉ, has requested additional time to exchange affidavits and submit legal arguments. Dermot Francis Sheehan, representing Brady and Synnott, has suggested mediation as a potential resolution. BreakingNews.ie
