Italy to Crack Down on Uninsured Drivers with Automated Camera Systems

Italy is set to implement a new system to detect and penalize drivers operating vehicles without mandatory insurance, leveraging existing traffic camera infrastructure. The initiative, spearheaded by Minister of Infrastructure and Transport Matteo Salvini, aims to significantly reduce the number of uninsured vehicles on Italian roads, which currently exceeds the European average.

New Enforcement Measures

Currently, traffic police identify approximately 30,000 uninsured vehicles annually out of 1.5 million checked according to Agenzia Nova. The new regulations will expand enforcement capabilities by utilizing cameras already in place for monitoring restricted traffic zones (ZTLs) and other traffic violations. These cameras will automatically check vehicle insurance status in addition to their existing functions.

Legislative Process and Privacy Concerns

The implementation requires a new law, rather than a decree, in coordination with the Ministry of Business and Made in Italy. Consultation with IVASS (the Italian Insurance Supervision Authority) and the Guarantor for the Protection of Personal Data is also required. The goal is to have the legislation approved by next summer as stated by Salvini.

A key consideration is data privacy. The Privacy Guarantor mandates that data related to insured vehicles be immediately deleted, retaining information only for those found to be in violation. The existing camera systems currently only store license plate data when an offense is committed; technical adjustments are needed to enable remote insurance status checks.

Penalties for Driving Without Insurance

Driving without insurance in Italy currently carries fines ranging from €866 to €3,464. Additional penalties include vehicle seizure and suspension of the driver’s license for repeat offenders. More significantly, drivers involved in at-fault accidents while uninsured are personally liable for all damages and may face asset seizure.

Protection for Accident Victims

The Road Victims Guarantee Fund provides protection for individuals injured in accidents caused by uninsured drivers. This fund will seek reimbursement from the responsible party. But, uninsured drivers themselves are not entitled to compensation from the fund in the event of an accident.

Broader Road Safety Initiatives

These measures are part of a broader effort to improve road safety in Italy. Minister Salvini also highlighted ongoing initiatives to enhance safety for public transport workers, including technological solutions for driver protection and the renewal of the public transport fleet with new buses equipped with video surveillance and driver protection devices as reported by Agenzia Nova. Italy is also implementing new safety rules for private e-scooters, requiring helmets, insurance, and license plates according to Cities Today.
