Northwest Territories Civil Service Act: Phase II Modernization and Union Representation
The Government of the Northwest Territories (GNWT) is moving forward with Phase II of its Waterway Modernization Project, focusing on amendments to section 41 of the Civil Service Act. This phase centers on the structure of union representation for GNWT public servants. The GNWT anticipates introducing legislation addressing these amendments in the fall of 2026.
Public Consultation and Key Feedback
From October 2025 to January 2026, the GNWT actively sought feedback from bargaining partners and the public through the Speak Up website and an online survey. A total of 135 survey responses and 49 written comments were received. Key themes emerging from the consultations included a desire for stable working relationships, clear and predictable rules, and independent, expertise-based decision-making processes aligned with established Canadian models and Northern realities.
Participants expressed support for increased employee choice and representation by sector. While, concerns were too raised regarding the government’s role, potential risks and uncertainties, and the timing and scope of changes. Equity and inclusion considerations were prominent, particularly concerning the protection of Indigenous employees and employees with disabilities.
Legislative Development and Next Steps
The GNWT will incorporate the feedback received during public consultations and from the Standing Committee on Government Operations’ review of Bill 26 into the development of a legislative proposal. This proposal will aim to amend section 41 of the Civil Service Act. The GNWT remains committed to introducing the legislation in the fall of 2026.
