3M Belgium PFAS Lawsuit: Residents Seek Millions in Damages Over Contamination

PFAS Contamination Uncovered During Infrastructure Project

The contamination came to light during excavation perform for the Oosterweel connection, a major project on the Antwerp ring road, in 2021. The excavation revealed highly contaminated soil around the 3M plant, specifically with perfluorooctane sulfonic acid (PFOS), a byproduct of the broader PFAS family. [1]

What are PFAS?

PFAS (per- and polyfluorinated alkyl compounds) are a group of over 6,000 different chemical compounds that do not break down naturally, earning them the moniker “forever chemicals.” [3] They were historically used in a wide range of products, including textiles, carpets, cookware, firefighting foams, and cosmetics, to provide resistance to grease, oil, and water. Previous Legal Action and Findings

In 2023, a family living approximately one kilometer from the 3M plant initiated legal action after abnormally high levels of PFAS were detected in their blood and vegetable garden. [2] The justice of the peace ruled in their favor, citing excessive nuisance from the factory, and awarded provisional damages of 2,000 euros (500 euros per family member). [2] This initial ruling acknowledged the potential for long-term health effects, as PFAS-related health issues can take decades to manifest.

Current Lawsuit Details

The current lawsuit builds upon the same legal principle of excessive neighborly nuisance. Each of the 1,400 plaintiffs is seeking 20,000 euros in provisional damages, totaling 28 million euros.
