Illinois Governor JB Pritzker is demanding a refund of over $8.6 billion from former President Donald Trump following a Supreme Court decision that struck down his administration’s sweeping tariffs. The 6-3 Supreme Court ruling has prompted businesses and state leaders to seek reimbursement for tariffs paid. Governor Pritzker, a vocal critic of Trump, has taken a leading role in demanding financial redress for Illinois residents. In a letter to Trump, Pritzker requested a refund of $1,700 for each of the 5,105,448 households in Illinois, totaling $8,679,261,600. California Governor Gavin Newsom too called for the return of funds raised through Trump’s tariffs, stating they were an “illegal cash grab” that harmed working families. Following the Supreme Court ruling, Trump announced his intention to impose a 10% global tariff for 150 days to replace some of the emergency duties that were struck down. The Penn-Wharton Budget Model estimates potential refunds could reach $175 billion, but the distribution of these funds remains unclear.

Both Pritzker and Newsom are considered potential Democratic contenders for the 2028 presidential race. Their demands for tariff refunds are seen as a populist move, appealing to working families who felt the economic impact of the tariffs. Trump himself acknowledged that any refund process could take years, a shift from his previous statements suggesting Americans would receive a “rebate” due to the revenue generated by the tariffs.

Legal Considerations

Justice Brett Kavanaugh, in his dissent, noted that the Supreme Court ruling did not address the question of how, or if, the government should return the billions of dollars collected through the tariffs. New York Governor Kathy Hochul described the Trump administration’s tariffs as “an unlawful backdoor tax” on families, farmers, and small businesses.
