The High Court had ruled that certain actions – grabbing a minor girl’s breasts, breaking the string of her pyjama, and attempting to drag her under a culvert – did not constitute an attempt to rape, but rather “aggravated sexual assault” under the Protection of Children from Sexual Offences (POCSO) Act, 2012, which carries a lesser punishment.

The Supreme Court overturned the High Court’s decision, deeming it “patently erroneous” and restoring the trial court’s original summoning order. The Court recognized the broader need for guidelines to ensure judges approach sexual offence cases with sensitivity, free from social prejudices and patriarchal notions.

NJA to Constitute Expert Committee

To address this need, the Supreme Court has requested Justice Aniruddha Bose, Director of the National Judicial Academy, Bhopal, to form a “Committee of Experts.” This committee will be responsible for “Developing Guidelines to Inculcate Sensitivity and Compassion into Judges and Judicial Processes in the Context of Sexual Offences and other Vulnerable Cases.”

The committee will be chaired by Justice Bose and will include four additional domain experts, encompassing practitioners, academicians, and social workers. The committee is expected to consider previous initiatives, both judicial and administrative, and analyze their impact on the ground.

The committee’s mandate includes several key considerations:
