Singapore to Enhance Civil Legal Aid and Streamline Court Processes

Singapore is set to expand access to civil legal aid and modernize its civil enforcement procedures with new legislation planned for later this year. These changes aim to build the legal system more accessible and efficient for Singaporeans and permanent residents.

Expanded Access to Civil Legal Aid

Up to 1,000 more individuals are expected to qualify for civil legal aid following an increase in the per capita household income threshold. The threshold will rise from S$1,050 to S$1,650 . The income limit for bank savings and non-Central Provident Fund investments will also be raised from S$10,000 to S$12,000 for both civil legal aid and criminal defense aid . The most common types of cases seeking civil legal aid involve matrimonial disputes, monetary claims and probate matters .

Streamlined Civil Enforcement Processes

A new Bill will be introduced to simplify civil enforcement processes, granting courts greater authority to identify the assets of those who owe debts and introducing new methods to ensure compliance with court orders . The legislation will also establish a new class of Civil Judgment Enforcement Officers, regulated by the Ministry of Law (MinLaw), to assist parties in enforcing civil judgments .

Currently, the time, effort, and costs associated with enforcing judgments can be disproportionate to the amount owed, leading to some judgments remaining unenforced . The aim of the new legislation is to make civil enforcement more effective, efficient, and affordable.

Optimizing State Property Use

The Singapore Land Authority (SLA), in collaboration with other agencies, will be offering longer tenures for leases on selected state properties, subject to planning considerations . This move is intended to encourage greater innovation in how state properties are utilized.

Law Minister Edwin Tong emphasized the importance of continually updating and improving Singapore’s legal policies to maintain its position as a leading legal and professional services hub .
