Supreme Court Reconsiders New York School Vaccine Requirements
The U.S. Supreme Court has instructed a lower court to re-examine New York’s ban on religious exemptions to school vaccination requirements. This decision, issued December 9, 2025, impacts students across the state and reignites the debate surrounding mandatory vaccinations and religious freedom.
New York eliminated non-medical exemptions, including religious ones, for required vaccinations for schoolchildren in 2019 following a measles outbreak. Parents challenging the ban argued it violated their constitutional rights. The case initially reached the Second Circuit Court of Appeals, which upheld the state’s authority to enforce the mandate.
However, the Supreme Court’s action doesn’t indicate a ruling on the merits of the case. Instead, the Court is asking the lower court to reconsider the case considering recent Supreme Court decisions concerning religious freedom. Specifically, the Court wants the Second Circuit to revisit the case considering 303 Creative LLC v. Elenis (2023), which addressed free speech and public accommodation, and Vidmar v.Maples (2024), concerning procedural due process.
This sends the case back to the Second Circuit for further review. The lower court will need to determine how these newer rulings apply to the New York vaccine mandate.Its important to note that the Supreme Court did not grant certiorari – meaning they didn’t agree to hear the case themselves at this time. They simply directed the lower court to take another look.
The outcome of this review could have significant implications. A ruling against New York could open the door to challenges of similar vaccine mandates in other states. Conversely, upholding the mandate would reinforce states’ rights to protect public health through vaccination requirements.
Families and school districts in New York are awaiting further guidance.
