WVU Board of Governors Proposes Updates to Drug and Alcohol Testing Rule

Teh West Virginia University (WVU) Board of Governors has issued a Notice of Proposed Rulemaking to amend its talent and Culture Rule 3.4,concerning Drug and Alcohol Testing for positions covered by the Federal Transit Administration (FTA) and Federal Motor Carrier Safety Administration (FMCSA). The proposed changes aim to align the rule with current University practices and clarify the scope of positions subject to testing.

Key Changes Proposed

The amendments include several key updates:

* Expanded Authority: The proposed rule grants explicit authority to the WVU President or their designee to establish drug testing policies for positions not currently covered under Rule 3.4.
* Clarified Scope: the rule will more clearly define which University positions fall outside the scope of the existing drug and alcohol testing requirements.
* Updated Contact facts: The contact information for the University office responsible for administering drug and alcohol tests under the rule will be updated.

Public Comment Period

The proposed rule and supporting documentation are available for public review and comment from November 10th through December 11th, 2023, at 11:59 p.m. Interested parties can access the proposed rule and submit comments via the proposed Rule webpage. A comment form is available at the top of the rule page.

Review Process & final action

All public comments received, or a summary of them, will be posted on the university’s policy website for ten days before the Board of Governors takes final action on the rule. The Board may modify the rule based on the feedback received during the public comment period.
