The second week of the criminal case against Marius Borg Høiby (29) starts on Tuesday, and the court day begins with the victim B having to explain himself.

The police believe that victim B was raped in Lofoten in the autumn of 2023, and charges have been brought for rape with sexual intercourse. In addition, he allegedly filmed the woman’s abdomen without her knowing about it.

On these two counts, Høiby does not plead guilty.

Started with Tinder match

In the first week of the trial, Høiby explained that he and the victim B matched on the dating app Tinder before they met and ended up at nachspiel.

Before the nachspielet, Høiby and Crown Prince Haakon had been to an event at a night club.

Prosecutor Sturla Henriksbø has previously said that Høiby and victim B first had voluntary intercourse at the nachspielet, but then Høiby allegedly raped the woman who was unable to resist the act due to sleep and/or intoxication.

– A film was later found of the woman’s bare abdomen, while she was not moving, Henriksbø said in his opening procedure.

Facts about the indictment against Marius Borg Høiby

The public prosecutor has accused Marius Borg Høiby of a total of 38 offenses in the indictment and the additional indictment:

* Four rapes

* Abuse in close relationships against a former partner

* Against another former roommate, he is accused of several acts of violence, breach of peace, damage and breach of a restraining order

* He is also accused of having filmed the abdomen of a number of women without their knowledge or consent

* The indictment also includes, among other things, death threats, assaulting the police and several road traffic offences

On Monday 19 January 2026, additional charges were brought against Høiby. Here he is accused of a further six matters:

* One case of gross violation of the Narcotics Act

* Two new cases of violation of the restraining order

* Three cases of reckless driving with a motorcycle

Sleep expert takes up heart rate monitor evidence

The victim was wearing a pulse watch when the alleged rape took place, and data from this watch is part of the prosecution’s evidence.

They believe that data from the heart rate monitor can say something about whether the victim was asleep or not, with the help of the pulse, but in the introductory procedure Henriksbø said that there could be irregularities and errors related to the heart rate monitor’s measurements.

Therefore, sleep expert and professor Ståle Pallesen has been summoned as an expert witness on Thursday, where he will give his expert assessment.
