Notting Hill Couple Ordered to Remove Rooftop Planters After Neighbor Dispute
A wealthy couple in Notting Hill, London, have been ordered to dismantle rooftop planters at their £2.5 million home following a protracted dispute with neighbors. Nicolas Joseph and his wife, Stephanie, installed the planters on the terrace of their four-bedroom property, reigniting a feud that began with the previous owner.
Years-Long Feud
The current dispute stems from renovations made to the roof terrace, but the origins trace back to the property’s previous owner, Lady Samantha Kane, a trans barrister. Neighbors initially raised concerns when Lady Kane transformed the flat roof into a terrace, citing privacy issues.
After purchasing the home in 2022, the Josephs increased the height of the rear terrace wall and subsequently added a ring of aluminum plant boxes around the perimeter. Some neighbors argued that the planters created a “barricade” and obstructed light.
Council Enforcement Action
Kensington and Chelsea council launched enforcement action in August, asserting that the planters were installed without the necessary planning permission. The Daily Mail reports that the couple maintained the planters caused no harm and enhanced privacy.
Planning Inspectorate Ruling
The Planning Inspectorate described the planters as “stark” and “prominent,” concluding they had a “harmful impact on the outlook of neighboring properties.” Planning inspector Jason Whitfield determined the planters represented “a substantial increase in the height of solid expanse of built form.”
While the inspectorate acknowledged the planters did not negatively affect the area’s character or privacy, they ruled the impact on neighboring properties’ views was significant. The Josephs were given three months, from February 11th, to remove the structures.
Neighborhood Reactions
Reactions within the affluent neighborhood were mixed. Some residents supported the council’s decision, emphasizing the importance of preserving the historic character of the area, which was once a notorious slum known as the “Potteries and the Piggeries.” Others felt the enforcement action was excessive, arguing the planters were aesthetically pleasing and did not cause significant harm.
Previous Owner’s History
Lady Samantha Kane, the previous owner, is noted for being one of the few individuals in the UK to have transitioned genders three times. She sold the property to the Josephs for £2.2 million in 2022 and now owns a castle in Scotland.
The Josephs expressed their disappointment with the ruling, stating they “never imagined that having a lawful roof terrace would indicate so much trouble.” They similarly pointed out the existence of other roof terraces in the area and questioned the proportionality of the enforcement action.
