In March 2023, Ms. Lubas was involved in a motorcycle accident when an oil leak from another vehicle created a hazardous road condition, causing her to lose control. The resulting fall led to fractures of the fourth and fifth metacarpal bones in her hand, as well as notable abrasions to her leg. Ms. Lubas now requires significant support from her partner to manage daily activities due to the debilitating pain.

Disputed Claims and Delayed Therapy

Ms. Lubas sought compensation from HDI Versicherung AG to cover medical expenses and ongoing care. While the insurer made some initial payments, Ms. Lubas argues these were substantially insufficient to address the full extent of her damages. She turned to consumer advocacy for assistance in 2024, hoping to resolve the impasse.

The Stalemate and Concerns Over Access to Care

Legal counsel representing Ms. Lubas, peter Petz, expressed frustration with the lack of clear communication from the insurance company. “It’s perplexing that they haven’t provided a detailed breakdown of their calculations or the reasoning behind their denial of further payments,” Petz stated. “If there are questions regarding the claims, why aren’t they being addressed? Open dialog and clarification are crucial to resolving these issues.”

Experts commissioned by the insurance company estimate that Ms. Lubas will require two to three years of treatment, incurring substantial costs. A critical concern is Ms. Lubas’s inability to self-fund these therapies. Without insurance coverage, access to necessary treatment is delayed, potentially exacerbating her pain and increasing long-term healthcare costs. As Petz aptly put it,”It’s a vicious cycle – delayed healing leads to increased pain,which in turn drives up expenses.” This situation mirrors a common challenge faced by individuals with chronic pain conditions, where timely intervention is vital for improving outcomes.

A Plea for Resolution and the Insurer’s Response

Resetarits, involved in the advocacy efforts, voiced hope for a mutually agreeable solution, avoiding the need for protracted legal proceedings. Though, HDI Versicherung AG remains firm in its position.

In response to inquiries, the insurer issued a statement: “Based on the information currently available to us, we will not be providing further compensation and are referring Ms. Lubas to the legal process. We regret that we cannot disclose specific details regarding this case.”
