Austria Opens Door to ‘Social Egg Freezing’

Austria’s Constitutional Court has delivered a landmark ruling: women can now freeze their eggs for personal reasons. This marks a significant shift in the country’s reproductive rights landscape.

The court deemed the existing ban unconstitutional, citing a violation of women’s right to private and family life. Expect this change to take effect on april 1st,2027,giving lawmakers time to draft new legislation,as reported by ORF.

Why the Ban was Overturned

“Social egg freezing” is the process of preserving unfertilized eggs for future use with IVF. It allows women to perhaps extend their reproductive options. Previously, austria only permitted egg freezing when medical treatment-like chemotherapy-threatened fertility.

The Constitutional Court found this restriction “disproportionate.” It wasn’t justified by health or ethical concerns. Judges clearly stated that the desire to have children, whether naturally or through assisted reproduction, is a fundamental right protected by the European Convention on Human Rights.

The court understands that assisted reproductive technologies raise ethical questions.However, they determined that freezing eggs for later IVF doesn’t inherently violate any constitutional principles.This decision empowers women to make proactive choices about their future families.
