Florida Advances Legislation to Enhance Alzheimer’s Care and Awareness

Florida lawmakers have unanimously approved two bills aimed at bolstering support and protection for the state’s estimated 580,000 seniors living with Alzheimer’s disease. The legislation, passed by both the House and Senate, now awaits Governor Ron DeSantis’ signature. The bills focus on creating a specialized licensing system for memory care facilities and launching a statewide Alzheimer’s awareness campaign.

Specialized Memory Care Licensing

Senate Bill 1404 establishes a latest, specific license for assisted living facilities providing memory care services. SB 1404 requires facilities advertising or offering care for individuals with Alzheimer’s disease or related dementias to obtain this license in addition to their standard assisted living license. The Agency for Health Care Administration (AHCA) will develop standards for this license by July 2027.

These standards will encompass:

  • Policies and procedures for delivering memory care.
  • Standardized criteria for resident admittance.
  • Minimum levels of care, services, and activities.
  • Mandatory training requirements for staff.
  • Specific safety protocols for memory care residents, including 24-hour staff coverage.
  • Physical plant requirements tailored to the needs of residents with dementia.

AHCA will also establish guidelines regarding advertising claims made by facilities lacking a memory care services license.

Statewide Alzheimer’s Awareness Campaign

The second bill, SB 578, initiates a statewide Alzheimer’s awareness campaign. This initiative will involve a partnership with a statewide nonprofit organization to enhance support and access to information about Alzheimer’s disease. The campaign will utilize a website, advertising, in-person outreach, and educational resources for healthcare providers.

Representative Dean Black (R-Jacksonville) emphasized the importance of the awareness campaign, stating that Florida was previously one of the few major states without such an initiative.
