Irish Companies Under Investigation for Potential Data Centre Construction Cartels
Irish authorities, including the Competition and Consumer Protection Commission (CCPC), are conducting raids and investigations into potential anti-competitive practices in the data centre construction sector. The European Commission has also launched an inquiry into similar practices across the EU.
The focus of the investigations is on “no-poach” agreements, where companies collude to avoid hiring each other’s employees. This practice is suspected in the data centre construction industry due to high demand for skilled professionals.
Building group Sisk, known for its operations in Ireland and other EU countries, confirmed involvement in the investigations, stating full cooperation with authorities. They declined to comment further.
The European Commission declined to name the specific companies raided but confirmed their investigation into possible anti-competitive behavior within the data centre construction sector.
Data Centre Growth and Competition
The Republic of Ireland has seen a surge in data centre development, attracting major multinational investments. Large Irish construction companies with experience in technology and pharmaceutical buildings have moved towards this sector.
However, data centre construction faces increasing scrutiny due to concerns over energy consumption. The State’s Commission for the Regulation of Utilities is expected to release a report on data centre building in Ireland soon.
Legal Ramifications and Potential Leniency
Violations of EU and Irish competition law can result in substantial fines and penalties. The European Commission offers leniency programs, providing immunity or reduced fines to companies that report anti-competitive practices and cooperate with investigations.
