Microsoft to Continue Offering Anthropic’s Claude AI to Most Customers Despite Pentagon Restrictions

Enterprises and startups utilizing Anthropic’s Claude AI through Microsoft products can continue to do so, with one key exception: the U.S. Department of War (Department of Defense). Microsoft has affirmed it will maintain access to Anthropic’s models for its customers, even as the Pentagon escalates its dispute with the AI startup.

Pentagon Designates Anthropic as Supply Chain Risk

The Department of Defense designated Anthropic as a supply chain risk after the company declined to provide unrestricted access to its technology for applications it deemed unsafe, including mass surveillance and fully autonomous weapons systems. This designation, typically reserved for foreign adversaries, prevents the Pentagon from directly using Anthropic’s products and requires any entities working with the Pentagon to certify they do not utilize Anthropic’s models.

Anthropic to Challenge Designation in Court

Anthropic has announced its intention to legally challenge the designation. CEO Dario Amodei stated the designation “plainly applies only to the use of Claude by customers as a direct part of contracts with the Department of War, not all use of Claude by customers who have such contracts.” He further clarified that the designation doesn’t limit uses of Claude or business relationships unrelated to specific Department of War contracts [TechCrunch].

Microsoft’s Legal Review and Continued Support

Microsoft’s legal team has reviewed the designation and concluded that Anthropic products, including Claude, can remain available to customers—excluding the Department of War—through platforms such as Microsoft 365, GitHub, and Microsoft’s AI Foundry. Microsoft is the first major technology company to publicly assure its customers of continued access to Anthropic’s models following the Pentagon’s actions.
