NYC Workers Gain Fresh Protections with Expanded Time Off Law
New York City workers are now entitled to 32 hours of protected time off annually, thanks to a new law that took effect this weekend, February 22, 2026. Mayor Zohran Mamdani championed the legislation, aiming to ensure employees are aware of their rights and can address personal needs without fear of job repercussions.
Addressing a Critical Need for Work-Life Balance
The law guarantees all New York City employees 32 hours of unpaid leave from the beginning of each year, or from their employment start date, whichever is later. Mayor Mamdani highlighted that the previous system, where time off accrued over the year, often forced workers into difficult choices between their jobs and personal obligations. As reported by ABC7 New York, the mayor emphasized the importance of allowing workers to handle unexpected life events – from childcare issues to family emergencies – without risking their livelihoods.
Protecting Workers from Retaliation
Councilmember Sandy Nurse, the law’s sponsor, underscored the need to protect employees from retaliation for utilizing their time off. “Life happens,” Nurse stated. “Things come up…You shouldn’t have to face retaliation for that. You should be able to go handle your business, capture care of people who depend on you and keep your job.”
Real-Life Impact on New York City Families
The new law addresses a significant concern for many New York City workers. One delivery worker shared a personal story with Mayor Mamdani, explaining the challenges of balancing work with a family member’s serious illness. “The mother of my children is currently dealing with brain cancer,” the worker said. “It would help if I did have a little bit of extra time at the job where I didn’t have to feel a little bit guilty, as if I could possibly lose my job by trying not to lose a life in my family.”
Enforcement and Compliance
The city’s Department of Consumer and Worker Protection (DCWP) will conduct compliance checks to ensure employers are adhering to the new law. Mayor Mamdani noted that a lack of utilization of paid time off within a workforce can be a “red flag,” indicating that employees may be discouraged from taking the time they are entitled to. According to the CDC, half of private sector workers do not utilize any sick time.
Mamdani’s Broader Focus on Worker Rights
This initiative is part of a broader effort by Mayor Mamdani to advocate for New York City workers. He has also been actively encouraging Amazon workers to unionize, as highlighted in a recent rally in Queens with Teamsters representatives.
