L.A. District Attorney George Gascón has thrown his weight behind Erik and Lyle Menendez’s bid for clemency. Gascón penned letters, publicly released on Wednesday, urging California Governor Gavin Newsom to grant clemency for the brothers convicted of killing their parents in 1989.
These letters, alongside Gascón’s vocal support, shed new light on the controversial case.
Gascón’s Case for Clemency
Gascón’s letters detail “credible allegations” against Jose Menendez, both brothers’ father, concerning sexual and physical abuse toward Erik and Lyle. “They have respectively served 34 years and have continued their educations and worked to create new programs to support the rehabilitation of fellow inmates,” Gascón stated in his official stance.
Gascón emphasizes the brothers’ dedication to rehabilitation during their 34 years imprisonment, highlighting their educational pursuits and efforts to aid other inmates. He posits that their lengthy incarcerations, coupled with evident remorse, make them exemplarily suited for clemency.
Adding credence to Gascón’s position, he revealed consultation with several members of Jose and Kitty Menendez’s family. Notably, all except Kitty Menendez’s brother expressed unwavering support for commutation.
Resentencing Motion and the Path Forward
Gascón’s advocacy does not stop at clemency. Days prior, he filed a motion before the court, requesting for Erik and Lyle’s sentences to be reconsidered. Currently serving life behind bars without parole, he proposes a change to “life with parole,” qualifying them for immediate parole. Under California law, juveniles convicted of crimes, considering their age at the crime, are eligible for immediate parole.
A resentencing hearing, scheduled for December 11th, awaits Judge’s decision. Alongside this legal maneuver, Gov. Newsom holds the power to grant clemency, potentially leading to complete freedom for the brothers or reducing their sentences.
