Macau Pursues First National Security Trial

A Macau court has moved to trial in the territory’s first national security case, designating former pro-democracy legislator Au Kam San as a “principal offender” in charges related to the subversion of state power. Following a July 2 preliminary hearing, the court confirmed it will proceed with prosecution, citing allegations that Au maintained ties with external groups to endanger national security.

The Macau court issued a statement confirming that a judge determined there is sufficient evidence to prosecute Au for subversion of state power. Beyond the subversion charge, the court alleged that Au engaged in “establishing links with organisations, groups or individuals outside Macau… to commit acts endangering national security” and committed “breach of confidentiality.”

The court noted that a national security committee has authorized the suspect’s court-appointed legal counsel to continue representing him throughout the proceedings, asserting that the defendant’s due process rights remain protected under the law.

A Shift in Legislative Authority

Au Kam San served as one of Macau’s longest-serving pro-democracy legislators before he stepped down and chose not to seek re-election in 2021. A primary school teacher by profession, his case represents the first time the territory’s national security framework has been applied to a former legislator since the government expanded the scope of these laws in May 2023.

The 2023 legal expansion was framed by officials as a necessary measure to prevent foreign interference. This was further bolstered by a March bill that granted Macau judges the authority to mandate that national security cases be heard in camera. Additionally, the new regulations require defense attorneys to undergo security clearances before they are permitted to represent clients in such cases.

International Scrutiny and Transparency Risks

The progression of the case has drawn international attention. The European Union previously expressed concern regarding the arrest of Au, stating that the move signaled an “erosion of political pluralism” in the former Portuguese-ruled territory.

The court is expected to schedule specific hearing dates in the coming weeks.
