Trump Election Interference Case Dismissed in Georgia

A judge has dismissed the Georgia election interference case against former President Donald Trump and others after the prosecutor appointed to take over the case declined to pursue the charges. This decision marks the end of the last state-level legal effort to hold Trump accountable for his attempts to overturn the 2020 election results.

Background of the Case

In August 2023, a grand jury indicted Trump and 18 others, alleging a conspiracy to overturn the 2020 presidential election loss in Georgia . Fulton County District Attorney Fani Willis led the initial investigation and prosecution.

Disqualification of Fani Willis

The case faced significant challenges when Willis was disqualified from prosecuting the case in December 2023 by the Georgia Court of Appeals. The disqualification stemmed from an “appearance of impropriety” due to a romantic relationship between Willis and special prosecutor Nathan Wade . Willis had hired Wade to lead the case.

Georgia Supreme Court Decision

Willis appealed her disqualification to the Georgia Supreme Court, but the court declined to hear the appeal in March 2026, with a 4-3 vote . This decision effectively upheld the lower court’s ruling.

Case Dismissal and Future Prospects

Following Willis’s disqualification, the Prosecuting Attorneys’ Council was tasked with finding a new prosecutor to continue the case. Yet, Pete Skandalakis, executive director of the Prosecuting Attorneys’ Council of Georgia, decided not to pursue the charges, leading Fulton County Superior Court Judge Scott McAfee to dismiss the case entirely in November 2025 .

The dismissal means it is unlikely Trump could be prosecuted on these charges as a sitting president .

Financial Implications

President Trump is seeking over $6.2 million from the Fulton County District Attorney’s Office to cover attorney fees and costs incurred during the case . This request is based on a Georgia law allowing reimbursement of legal fees when a prosecutor is disqualified due to improper conduct and the case is subsequently dismissed .

The dismissal of the case affects all co-defendants, including Rudy Giuliani and Mark Meadows .
