US Circumvents Congress to Expedite Arms Sales to Israel Amidst Iran Conflict

The US State Department has invoked an emergency provision to bypass Congressional review and authorize the sale of over 20,000 bombs to Israel, in a package valued at approximately $660 million. This move comes as tensions escalate with Iran and aims to accelerate the delivery of armaments without the standard legislative approval process.

Escalating Tensions and Emergency Authorization

The decision to utilize the emergency provision of the Arms Export Control Act marks the first time the Trump administration has formally declared an emergency to circumvent Congress regarding arms sales to Israel. Previously, the administration had bypassed the informal Congressional notification process three times for arms sales or military aid to Israel, but had not invoked the emergency clause. In January, the State Department bypassed Congress to announce the shipment of four weapon systems to Israel, valued at a total of $6.5 billion.

According to officials, the emergency declaration was made due to “an emergency that requires the immediate sale” of 12,000 large bombs, each weighing approximately 450 kilograms, to Israel. The package also includes 10,000 bombs weighing around 225 kilograms and 5,000 smaller-diameter bombs, along with associated services and accessories, bringing the total value to over $500 million.

Recent History of US-Iran Conflict and Arms Sales

The current escalation builds upon a history of US-Iran tensions. In June of the previous year, the United States bombed Iran in support of Israel, which had targeted the country. This earlier conflict, known as the ‘War of the 12 days,’ concluded after twelve days with a ceasefire. More recently, on February 28th, the United States, alongside Israel, initiated a military campaign against Iran, aiming to eliminate Iranian leaders and disrupt its missile and nuclear programs.

The US provides Israel with $3.8 billion in annual aid, which Israel uses to purchase weaponry, often from American companies.

Congressional Concerns and Criticisms

Some members of Congress have expressed criticism regarding the decision to bypass the legislative process. Representative Gregory W. Meeks, the ranking Democrat on the House Foreign Affairs Committee, stated that invoking the emergency authority “exposes an evident contradiction at the heart of this administration’s justification for war.” He further argued that the administration’s claim of being prepared for war is undermined by the need to invoke an emergency to circumvent Congress.

Manufacturing Details

The 450-kilogram bombs included in the sale are manufactured by Repkon USA, a subsidiary of the Turkish company Repkon.

Previous Emergency Declarations

The Biden administration also utilized the emergency provision twice in 2023 to expedite arms shipments to Ukraine following the Russian invasion. The Trump administration previously declared an emergency involving Iran in 2019 to authorize $8.1 billion in munitions sales to Saudi Arabia and the United Arab Emirates, a decision that was later reviewed by the department’s inspector general.
