152 © BBV Path navigation Home Current releases for the media Red and yellow areas are now ineffect Federal Administrative Court Overturns Bavarian Fertilizer Ordinance Implementation October 24, 2025 – A significant victory for Bavarian farmers has been achieved as the Federal Administrative Court (Bundesverwaltungsgericht) today declared the Bavarian Implementation Ordinance on the Fertilizer Ordinance (AVDüV) ineffective. This decision follows years of advocacy by the Bavarian Farmers’ Association and other agricultural stakeholders. The court’s ruling centers on constitutional concerns regarding the designation of “red” and “yellow” areas – zones subject to stricter fertilizer restrictions. The court determined that the existing legal framework did not meet constitutional requirements and failed to adequately protect fundamental rights related to property and freedom of occupation. specifically, Section 13a Paragraph 1 of the Fertilizer Ordinance (DüV) was found to lack sufficient clarity regarding the criteria for identifying polluted areas requiring stricter regulation. Farmers must still comply with the general requirements of the Fertilizer ordinance. The Bavarian Farmers’ Association has pledged to actively participate in the development of new regulations, advocating for practical, transparent rules that allow agricultural businesses to operate effectively. The association highlighted the economic burdens and restrictions faced by farmers due to previous,frequently enough unclear,area designations. This court decision represents a crucial step towards achieving fertilizer regulations that are both environmentally sound and considerate of the needs of the agricultural community.
