Super Micro Executives Charged with Illegal Chip Exports to China

U.S. Prosecutors have charged three individuals connected to Super Micro Computer Inc. With illegally diverting billions of dollars worth of Nvidia AI chips to China, violating U.S. Export control laws. The charges approach as the U.S. Government intensifies its efforts to prevent advanced technology from reaching China without authorization, amid growing competition in the artificial intelligence sector.

Key Allegations and Individuals Involved

Yih-Shyan “Wally” Liaw, a co-founder and board member of Super Micro, Ruei-Tsan “Steven” Chang, a manager at the company’s Taiwan office, and Ting-Wei “Willy” Sun, a contractor, are accused of conspiring to violate the Export Control Reform Act, smuggling goods, and defrauding the United States. The indictment alleges they worked together to illegally divert servers containing Nvidia chips to China between 2024 and 2025 .

According to prosecutors, the diverted equipment is valued at approximately $2.5 billion . The scheme reportedly involved fabricated documents, staged audits, and a pass-through company to conceal the true destination of the servers .

Super Micro’s Response and Stock Impact

Super Micro Computer has stated that the alleged actions of the three individuals contravene the company’s policies and compliance controls. The company has placed Liaw and Chang on administrative leave and terminated its relationship with Sun. Super Micro affirmed its commitment to full adherence to U.S. Export control laws and is cooperating with the investigation .

Following the unsealing of the indictment, Super Micro’s stock price fell approximately 12% in extended trading .

Broader Implications and U.S. Export Controls

The U.S. Government has been increasingly focused on preventing the unauthorized transfer of advanced AI chips to China, as American companies like Anthropic and OpenAI face competition from Chinese rivals such as DeepSeek . Strict U.S. Export controls are in place, barring the sale of these chips to China without a license, to protect national security and foreign policy interests .

The Justice Department emphasized that diversion schemes like this generate significant illicit profits and pose a threat to U.S. National security .

Ongoing Investigation

The investigation is ongoing, and Chang remains at large. Liaw was arrested in California and released on bail, while Sun is currently being held awaiting a detention hearing .
