Late-night host Stephen Colbert publicly accused CBS of preventing him from airing an interview with Texas State Representative James Talarico, a Democratic candidate for U.S. Senate, citing concerns over potential repercussions from the Federal Communications Commission (FCC). The interview, which has since been published on YouTube, focused on the FCC’s recent actions and Talarico’s campaign.

FCC Pressure and the “Equal Time” Rule

Colbert revealed on Monday night’s episode of “The Late Show” that CBS’s legal team directly instructed him not to conduct the interview, and further prohibited him from even acknowledging its cancellation. This decision stems from new guidance issued in January by FCC Chairman Brendan Carr regarding the enforcement of the “equal time” rule. Traditionally, talk shows have been exempt from this rule when conducting “bona fide news interviews,” allowing them to book candidates without being required to offer equal time to their opponents. However, Carr’s guidance suggests that late-night and daytime talk shows should now comply with the rule, particularly if programming is deemed “motivated by partisan purposes.”

CBS’s Response and Concerns Over First Amendment Rights

Colbert expressed his frustration with CBS’s decision, stating that the network was “unilaterally enforcing” the FCC’s guidance even though it hasn’t been officially changed. He criticized the Trump administration for attempting to control what is broadcast on television, calling it “the most dangerous kind of cancel culture.” Talarico, in the unaired interview, echoed these concerns, accusing the administration of “selling out the First Amendment to curry favor with corrupt politicians.”

Broader Context: FCC Crackdown and Political Influence

This incident occurs within a broader context of increased scrutiny from the FCC, led by Chairman Carr, towards networks that have drawn criticism from the President. The FCC recently opened a probe into ABC’s “The View” following a previous appearance by Talarico. Talarico’s Campaign and the Texas Senate Race

James Talarico is currently competing for the Democratic nomination for the U.S. Senate seat in Texas, facing off against U.S. Representative Jasmine Crockett. The interview was scheduled to air the day before the start of early voting for the Texas primaries on March 3rd. During the interview, Talarico stated his belief that “Donald Trump is worried that we’re about to flip Texas.”

Stephen Colbert is set to leave “The Late Show” in May.
